What are the different types of divorce?

New Jersey couples who wish to get a divorce have different options. There are four types of divorce available. Knowing about them can help when deciding how to end the marriage.

Uncontested divorce

An uncontested divorce is one of the easier types. It’s possible for a couple to seek this type of divorce when they agree to end their marriage and are amenable to various issues related to the split. If a couple can agree about how to divide their property and debts, alimony, child support, child custody and visitation, they can easily get an uncontested divorce.

No-fault divorce

New Jersey has no-fault laws when it comes to divorce. This means that you can seek a divorce from the court without having to cite a specific reason behind it such as adultery or cruelty. A no-fault divorce means that all you need to claim is irreconcilable differences within the marriage.

Summary divorce

A summary divorce can be sought by married couples who have not been married for too long, have little to no assets and don’t have children. In order to get this type of divorce, both parties must agree and are required to file divorce papers jointly with the court. This type of divorce is also known as simplified divorce. The reason behind the name is that there isn’t much paperwork involved compared with other, more complex divorce options.

Limited divorce

A limited divorce is like a legal separation. It allows couples to go through their finances and settle matters prior to the finalization of the divorce. It requires the parties to live separately and refrain from romantic contact during the process.
